Acceptance of Terms
By downloading, installing, creating an account, or using KAIND® (the "App," the "Service"), you confirm that you have read, understood, and agreed to be bound by these Terms of Service ("Terms") and our Privacy Policy.
These Terms form a legally binding agreement between you and MBR Group LLC ("KAIND," "we," "us," "our"). If you do not agree, do not access or use the Service.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use after changes constitutes acceptance.
The Service
KAIND® is a frequency wellness application that delivers binaural beats, isochronic tones, voice frequency analysis, breathwork guidance, soundscapes, and related audio wellness content designed for personal use.

Premium features (subscription required)
- All 10 frequency programs (Delta, Theta, Alpha, Beta, Gamma, Schumann, and more)
- Voice Mirror — real-time Chladni pattern visualization
- Voice Frequency Analysis — microphone-based program recommendation
- MindSync — your voice layered with binaural frequencies
- Custom frequency tuning — precise beat and carrier control
- Session history, streaks, XP, and personalized recommendations
- Do not use KAIND® while driving or operating heavy machinery
- Use at a safe, comfortable listening volume to protect your hearing
- If you experience dizziness, discomfort, or unusual sensations, stop use immediately
Subscriptions & Payments
KAIND® Premium is offered as an auto-renewing subscription. The following plans are currently available:
Prices are in US dollars. Applicable taxes may apply. We reserve the right to change pricing with at least 30 days advance notice.
Payment processors
- Apple App Store (iOS): Subscriptions purchased through the iOS app are billed through your Apple ID and governed by Apple's payment terms. We do not receive or store your payment details. Manage at: Settings → Apple ID → Subscriptions.
- Stripe (web): Subscriptions purchased at kaind.app are processed by Stripe, Inc. Stripe stores your payment information securely in accordance with PCI-DSS standards. We receive only confirmation of payment — never your card details.
Free Trial
KAIND® offers a 14-day free trial for new Premium subscribers. During the trial you have full access to all Premium features at no charge.
- Your payment method is required at signup but will not be charged until the trial ends
- Cancel at any time before the trial ends to avoid being charged
- If you do not cancel, your subscription begins automatically on day 15
- One free trial per person — trial eligibility is determined by Apple or Stripe based on your account history
Cancellation & Refunds
How to cancel
- iOS subscribers: Settings → Apple ID → Subscriptions → KAIND → Cancel Subscription. Must cancel at least 24 hours before renewal.
- Web subscribers: Manage via the billing portal in your KAIND profile, or email hello@kaind.app.
When you cancel, you retain Premium access until the end of your current billing period. After that, your account reverts to the free plan.
Refunds
We do not offer refunds for partial subscription periods. If you believe you were charged in error, contact us within 14 days at hello@kaind.app.
For iOS subscriptions, refund requests must be submitted to Apple at reportaproblem.apple.com and are subject to Apple's refund policy.
Your Account
To access certain features, you may create a KAIND account using your email and password or sign in through Apple. You are responsible for the security of your credentials and all activity under your account.
- You may not share your account or use it for commercial purposes
- One account per person — duplicate accounts may be removed
- Notify us immediately at hello@kaind.app if you suspect unauthorized access
- Delete your account at any time in the app under Profile → Delete Account. Data is removed within 30 days
Acceptable Use
You agree to use KAIND® only for lawful personal wellness purposes. You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the App
- Use the Service for any unlawful, harmful, or fraudulent purpose
- Attempt to gain unauthorized access to our systems, servers, or databases
- Reproduce, redistribute, or resell our audio content or proprietary material
- Use automated tools or bots to access the Service
- Circumvent any technical measures protecting the Service
- Create derivative works based on KAIND content without written permission
Intellectual Property
All content within KAIND® — including audio frequencies, soundscapes, visual designs, written content, algorithms, and interface elements — is owned by or licensed to MBR Group LLC and protected by copyright, trademark, and applicable intellectual property law.
Your subscription grants you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial wellness purposes only. This does not include rights to download, copy, redistribute, or use our content commercially.
The KAIND® name, logo, and all related branding are exclusive trademarks of MBR Group LLC. Unauthorized use is prohibited.
Disclaimers & Limitation of Liability
No warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations.
Limitation of liability
To the fullest extent permitted by applicable law, MBR Group LLC and its officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.
Our total liability to you for any claim will not exceed the total amount you paid to KAIND in the 12 months preceding the claim.
Health outcomes
KAIND makes no clinical or medical claims about outcomes. Individual results vary. Our audio content is designed for general wellness and has not been evaluated by the FDA or any equivalent regulatory body.
Apple App Store Terms
If you access KAIND® through the Apple App Store, the following additional terms apply:
- These Terms are between you and MBR Group LLC — not Apple, Inc. Apple is not a party to these Terms and has no obligation to provide maintenance or support for KAIND.
- Any claims relating to KAIND — including product liability, consumer protection, or intellectual property claims — must be directed to MBR Group LLC, not Apple.
- In the event KAIND fails to conform to any applicable warranty, you may notify Apple for a refund of the App purchase price (if any). Apple has no further warranty obligations regarding KAIND.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you upon your acceptance.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Termination
You may delete your account at any time in the app under Profile → Delete Account. Your personal data will be permanently removed within 30 days.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or attempt unauthorized access to our systems. In such cases, no refund will be issued. Sections 8, 9, and 12 survive termination.
Governing Law & Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Disputes arising from these Terms will be resolved through binding individual arbitration in Los Angeles County, California, under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Either party may seek injunctive relief in a court of competent jurisdiction to prevent infringement of intellectual property rights.
If any provision of these Terms is found unenforceable, remaining provisions continue in full effect.
