Acceptance of Terms
By downloading, installing, or using KAIND® ("the App", "the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These Terms apply to all users including free users, trial users, and paying subscribers. We may update these Terms — continued use after notice of changes constitutes acceptance.
The Service
KAIND® is a frequency wellness application that provides binaural beats, isochronic tones, breathwork guidance, sleep protocols, and related audio wellness content for personal use.
- Do not use KAIND® while driving or operating heavy machinery
- Use at a safe, comfortable listening volume — protect your hearing
- If you have epilepsy or are photosensitive, consult your doctor before use
- KAIND® is not suitable for children under 13
Subscriptions & Payments
KAIND® offers a free trial followed by paid subscription plans. By starting a trial, you authorise us to charge your payment method at the end of the trial period unless you cancel before it ends.
- Monthly plan: $9.99/month, billed monthly
- Annual plan: $79/year (~$6.58/month), billed annually
- Free trial: 14 days — no charge until the trial ends
Subscriptions auto-renew unless cancelled. You may cancel at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of the current billing period — you retain access until then.
All payments are processed by Stripe. We do not store your payment information. Prices may change with 30 days' notice.
Refunds: We do not offer refunds for partial subscription periods. If you believe you were charged in error, contact us at [email protected] within 14 days.
Your Account
You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorised access.
You may not share your account or use KAIND® for commercial purposes without our written permission. One account per person.
You may delete your account at any time from within the app. Deletion is permanent — we will remove your personal data within 30 days.
Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the App
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Reproduce or redistribute our audio content without permission
- Use automated tools to access the Service
Intellectual Property
All content in KAIND® — including audio frequencies, soundscapes, visual designs, and written content — is owned by or licensed to KAIND® and protected by copyright. Your subscription grants you a personal, non-transferable licence to use the Service for personal wellness purposes only.
The KAIND® name, logo, and trademark are our exclusive intellectual property.
Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or specific wellness outcomes.
Individual results from frequency wellness practices vary. KAIND® makes no guarantees about the effectiveness of binaural beats or isochronic tones for any particular purpose.
Limitation of Liability
To the fullest extent permitted by law, KAIND® shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months prior to the claim.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.
If you are located in the European Union, you may also have rights under applicable EU law that cannot be waived by these Terms.
App Store & In-App Purchases
KAIND® is available on the Apple App Store. When you purchase a subscription through the App Store, payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
You can manage and cancel your subscription at any time in your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period — you retain access through the period you paid for.
Apple is not responsible for KAIND® or its content. Any claims relating to KAIND® — including product liability, consumer protection, or intellectual property infringement — must be directed to us, not to Apple. Apple has no obligation to provide maintenance or support services for KAIND®.
For subscriptions purchased directly through our website, manage billing at our billing portal.
Account Termination
You may delete your account at any time from within the app under Profile → Delete Account. Upon deletion, all your personal data is permanently removed from our systems within 30 days.
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the service. In such cases, no refund will be issued for unused subscription time.
Upon termination for any reason, your right to use KAIND® ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including intellectual property rights, warranty disclaimers, and limitations of liability.
Dispute Resolution
If you have a dispute with us, please email [email protected] first. We commit to attempting informal resolution within 30 days before either party pursues formal action.
If informal resolution fails, any dispute arising from or relating to KAIND® or these Terms will be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction for matters involving intellectual property.
By using KAIND®, you waive the right to participate in a class action lawsuit or class-wide arbitration against us.
